Health, safety and employment law is an important issue for any business, especially those who employ other people. You may not realise it when things are going well but if the unfortunate should happen it can have serious implications for your business.

The first thing you need to do when analysing your company's health and safety status is ask yourself a ferw simple questions. If you cannot answer yes to ALL of these questions then there could be serious implications for your business and therefore, health, safety and employment law is an issue you should be addressing:

  • Do you have up-to-date contracts of employment in place for all of your staff? if you have them are you sure that they reflect current employment law?
  • Are you sure that your contracts of employment would adequately protect you in the event of an employment tribunal? (the maximum award at a unfair dismissal related tribunal is now £50,000, and is unlimited for dicrimination related cases)
  • Do you keep up-to-date with new employment law?
  • Do you have access to specialized, guaranteed advice in the areas of employment law or safety?
  • Does your health & safety documentation adequately protect you and your business?
  • Can you demonstrate that you have not only had risk assessments done, but that they are managed and reviewed?
  • Do all of your staff know what their responsibilities are in respect of safety, as well as the standards that you expect of them in their day-to-day work activities?
  • In the event of an accident, are you sure that what you currently have written down forms the basis of a "due diligence" defence?
